“An Eye for an Eye Tooth for a Tooth:

This week’s Parshas Mishpatim, well known to every student of the Talmud enumerates the laws of damages, torts and property. Immediately following the narrative of the Sinai revelation the Torah emphasizes the natural transition to the laws of interpersonal relationships within a community of civil exchange.

One of the featured imperatives is that punishment should fit the crime. While Chazal explain that and eye for an eye and tooth for a tooth refer to a monetary compensation the Torah nevertheless emphasizes that one must accept responsibility for his actions and the punishment should be proportionate to the act.

One would need to be in a cocoon not to have an opinion of President Trump granting clemency to our former Governor Rod Blagojevich. Many feel that the punishment was disproportionate to the crime, that all politicians “horse trade” and Blagojevich was a victim of overzealous prosecution. If Biblical principles were invoked his sentence would have been far less than fourteen years in jail.

Yet when I listened to part of Mr. Blagojevich’s speech yesterday I was struck at how unrepentant he was for the actions he took and a failure to accept any responsibility for his actions. Sure one may criticize the length of the sentence but it should not preclude accountability for corruption and dishonest behavior.

Parhas Mishpatim concludes with yet another account of the Sinai revelation. Both immediately before and after the recitation of its laws do we find how they are sandwiched by Mount Sinai. This is our directive. All Torah law is a moral and ethical imperative, given to Moshe and the Bnei Yisroel at Sinai and we are to accept the Torah with complete subjugation to Hashem’s will.

¨From the Rabbi’s Study¨

Rashi cites a Midrash very early on in this weeks Parsha that expresses the view that only one fifth of the Jewish people left Egypt in the grand exodus that we read about this Shabbos and know full well from the Pesach seder. At first glance this would seem preposterous. After 10 plagues years of persecution and undeniable miracles one would have thought every individual would be so enthusiastic to get up and leave immediately. Yet Rashi prominently cites this Midrash and its commentary is part of our traditional lore. There are of course many traditional interpretations of this Midrash. For the time being however I’ll leave it to you to consider what might have gone through the minds and emotions of a persecuted nation, the hardships realities and naysayers. Its important that we study, analyze and understand Chazal in the traditional ways of the mesorah which will help guide us in the present world in which we live.

Make no mistake about it. The proposed peace proposal is not some major victory for Israel as reported in the media. For starters the U.S. has until now refused to present a proposal not negotiated by the parties themselves. Secondly the proposal presupposes a Palestinian State and an Arab capitol in the eastern half of Jerusalem. Furthermore the Israelis are expected to cease building homes in what we consider halachik or Biblical Israel. Nevertheless the “Palestinian” leadership has already rejected what might have been for them a great advancement of their society the likes of which may never be repeated. Like Pharaoh in this week’s Parsha they are obstinate and unable to see what is in their best interests. They remain steadfast in their hatred and will drown in the sea of discontentment. We pray for peace while they live in a world of false hope and self-defeatism. We hope and pray that Hashem brings shalom al Yisroel.

¨From the Rabbi’s Study¨

When I was a high school senior in the early 1970 I was privileged to be nominated as the senior representative at the Massachusetts State House sponsored annual high school symposium. We were to meet with the Governor and State legislators and conduct a mock legislative session where we would vote on bills proposed by my fellow students. I remember only one vote of significance since I was the lone dissenter among the 500 other budding student politicians. That vote was to legalize marijuana.

Lo and behold fifty years later it is now legal in Illinois to purchase marijuana with certain restrictions and on the very first day in 2020 that sales began the distributors ran out of inventory. We should however not be lulled into a false sense of security. Marijuana is a drug and the culture of dope is antithetical to a Torah observant life. We should therefore be vigilant within our community to educate our children and grandchildren to the evils of marijuana and live our lives by example.

While millions across the world celebrated New Years in somewhat nefarious ways, tens of thousands of bnei Torah descended on Met-Life Stadium to celebrate the culmination of Talmud study (siyum Hashas). The adage “ring out the old and bring in the new” has a completely different meaning to the observant Jew steeped in the study of Torah. We would rather say review the old and start again; for this exercise of Torah learning allows us to build on the special relationship we enjoy with Hashem. Let us therefore join the multitudes who are completing shas with a hearty mazel tov and our blessings for onward and upward.

`David Ben Gurion in an address shortly after a successful military victory in July 1948 during the war of Independence stated the following; “ I hope I have said enough to make you understand that VICTORY ALONE, BE IT THE MOST CONCLUSIVE IN WAR AND IN POLITICS, WILL NOT SOLVE OUR PROBLEMS. Even if we emerge into the light, our path will be beset by stumbling-blocks and vexed by mind-ventures. How to win through? …..
by intellectual and moral primacy.”

While I would not under usual circumstances quote Ben Gurion for divrei Torah he certainly understood the real challenge of establishing a moral society after the war of Independence. We celebrate a military victory on Chanukah not by parades but by lighting the menorah of the mitzvah Or.
